California Ignition Interlock Device (IID) Law

Arrested for DUI in Los Angeles? Here’s What You Need to Know About IID Requirements

If you’ve been convicted of DUI in California, there’s a good chance the court or DMV will require you to install an Ignition Interlock Device (IID) on your vehicle.

Since 2019, California has implemented a statewide IID program under Senate Bill 1046, which affects ALL DUI convictions—even first-time offenders. The law can be confusing, and the penalties can be burdensome. At KF Law, we help clients understand IID requirements, fight for reduced obligations, and protect their driving privileges after a DUI.

What Is an Ignition Interlock Device?

An Ignition Interlock Device (IID) is a small breathalyzer that’s wired into your car’s ignition. Before starting your vehicle, you must blow into the device. If any alcohol is detected, the car won’t start. Periodic “rolling retests” while driving are also required.

IIDs must be installed and monitored by a DMV-certified provider, and you are responsible for the costs.

When Is an IID Required in California?

IID requirements depend on the severity and number of DUI offenses:

First-Time DUI Offense (VC § 23152)

  • With injury: Mandatory IID for 6 months

  • Without injury:

    • Option to install IID for 4 months to retain full driving privileges

    • Or no IID and face 1-year restricted license

Second DUI Offense

  • Mandatory IID for 1 year

Third DUI Offense

  • Mandatory IID for 2 years

Fourth or More DUI Offense

  • Mandatory IID for 3 years

DUI with Refusal or Other Enhancements

  • You may face longer IID periods or license revocation

IID Requirements for Wet Reckless or Reduced Charges

If your DUI is reduced to a “wet reckless”, IID installation is not mandatory. That’s why it’s often a goal in DUI plea bargaining. We fight to get your charges reduced, not only to avoid jail time—but to help you avoid costly IID penalties as well.

Costs of an Ignition Interlock Device

IID costs vary, but most drivers can expect:

  • $70–$150 installation fee

  • $60–$80 monthly maintenance

  • Additional calibration or service fees

For many drivers, this can mean over $1,000 per year in out-of-pocket costs. If you qualify for low-income assistance, you may be eligible for reduced fees—we’ll help you apply.

Fighting IID Requirements

Depending on the circumstances, our DUI defense attorneys may be able to:

Challenge the DUI charge entirely to avoid IID
Negotiate a reduction to a non-IID offense
Request early removal of the IID if you meet certain criteria
Challenge DMV suspension in your administrative hearing

With the right strategy, it’s often possible to avoid or reduce your IID obligation—and we know how to make it happen.
